Acceptance of Terms

By accessing or using GutRise, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app. These Terms constitute a legal agreement between you and Libre Forge Inc.

Eligibility

You must be at least 16 years old to use GutRise. By using the app, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Description of Service

GutRise is a mobile application designed to help users track intermittent fasting, monitor health metrics, and receive wellness insights. The app includes features for logging meals, weight, sleep, activity, and water intake.

Medical Disclaimer

IMPORTANT: GutRise is a wellness tracking tool, NOT a medical device or medical advice.

• GutRise does not diagnose, treat, cure, or prevent any medical condition
• The app is not a substitute for professional medical advice, diagnosis, or treatment
• Always consult your healthcare provider before starting any fasting regimen
• If you experience any adverse health effects, discontinue use and seek medical attention
• AI-generated nutritional insights are estimates and should not be used for medical decisions

User Accounts

You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must provide accurate information and keep it updated.

Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the app's functionality
• Reverse engineer or decompile the app
• Use the app to harass, abuse, or harm others

Intellectual Property

GutRise and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

AI-Generated Content

GutRise uses artificial intelligence to analyze food photos and provide nutritional estimates. This AI-generated content is provided for informational purposes only and may contain inaccuracies. You should not rely solely on AI analysis for dietary decisions.

Subscriptions and Payments

GutRise offers optional premium features through subscription plans. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple App Store account settings. Refunds are handled according to Apple's App Store refund policies. Prices may change with reasonable notice.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIBRE FORGE INC. DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIBRE FORGE AND GUTRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. This includes, without limitation, any health problems, medical conditions, injuries, or adverse health effects that may occur during or after using the app, regardless of whether such issues are related to fasting, nutrition, or any other aspect of the app. Under no circumstances shall Libre Forge be held responsible for any user's health outcomes. Our total liability shall not exceed the amount you paid for the app in the past 12 months.

Indemnification

You agree to indemnify, defend, and hold harmless Libre Forge Inc., GutRise, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your access to GutRise at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Dispute Resolution

Any dispute arising from these Terms or your use of GutRise shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the Province of Quebec, Canada, in accordance with the applicable arbitration rules. You agree to waive any right to participate in class action lawsuits or class-wide arbitration against Libre Forge Inc.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Libre Forge Inc. regarding your use of GutRise and supersede any prior agreements or understandings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the app or sending you a notification. Your continued use of the app after such changes constitutes acceptance of the modified Terms.
